Commonwealth of Massachusetts

FRANKLIN, ss.

To the Constable of the Town of Wendell in the County of Franklin.

Greetings:

In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and in Town affairs, to meet at the Town Hall in said Town on Wednesday October 6, 2010 at 7:00 PM, then and there to act on the following articles:

ARTICLE 1: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $500 to pay the remainder of the FY10 Audit invoice or take any action thereon.

ARTICLE 2: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $110 to pay a bill of prior year to Howard Laboratories, Inc., or take any action thereon.

ARTICLE 3: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $1900 to pay for updating the Town’s Open Space and Recreation Plan, or take any action thereon.

ARTICLE 4: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $2700 for the purchase of a storage trailer to be used by the Cemetery Commission, or take any action thereon.

ARTICLE 5: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $26,000 to purchase a replacement poly tank for the Fire Department tanker truck, or take any action thereon.

ARTICLE 6: To see if the Town will vote to reduce the size of the Open Space Committee from seven members to five members, or take any action thereon.

ARTICLE 7: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $5000 to hire a Money Management Consultant or take any action thereon.

ARTICLE 8: To see if the Town will vote to establish the position of Financial Director and raise and appropriate or transfer from available funds the sum of $2800 to cover the salary costs for this position or take any action thereon.

ARTICLE 9: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $2500 to pay for costs associated with replacing windows in the Police Station or take any action thereon.

ARTICLE 10: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $3000 to pay for costs associated with the purchase and installation of new hot water heating system in Town Hall or take any action thereon.

ARTICLE 11: To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $1200 to the Grave Excavation Account to pay for costs associated with grave openings or take any action thereon.

ARTICLE 12: To see if the town will vote to adopt and amend the following in the Wendell Zoning Bylaws or take any action thereon:

Add to Article III Definitions:
Special Permit Granting Authority (SPGA): The Special Permit Granting Authority pursuant to
Chapter 40A, M.G. L. and the Wendell Zoning Bylaws is the entity that has the power to impose any conditions, safeguards, and/or limitations on time or use of the premises granted under Special Permit.

Article V, section A, number 3, Change so that it reads: ”Each lot of a triplex dwelling will require a minimum of four (4) acres and 200 feet frontage and must obtain a Special Permit from the SPGA.”

Article V, section A, number 5 Change so that it reads: “Subject to special permit from the SPGA,one guest cabin may be located on any approved building lot.” The change replaces the term “Planning Board” with “SPGA.”

Article V section A, number 6, Change to read: “Subject to special permit from the SPGA, one
secondary dwelling may be located on any approved building lot provided the principal building with at least one dwelling unit has existed for 10 years prior to the issuance of the Special Permit.”

Article V1, section J, number 1 change to read: “Subject to a special permit from the SPGA, one secondary dwelling may be located on a building lot in accordance with the following requirements:”

Article VI, section J, number 1, f change to read: :The SPGA may waive setback requirements for conversion of a structure that has been in existence for the ten (10) years preceding application for this special permit, provided that such waiver is consistent with Special Permit criteria and does not compound any adverse impact on abutters.”

ARTICLE 13: To see if the town of Wendell will vote to establish a position entitled "Food
Production and Gardening Coordinator", to be appointed by the Selectboard, in consultation with the Energy Committee, and to raise and appropriate or transfer from available funds the sum of $5,000 to pay the salary associated with this position or take any action thereon.

ARTICLE 14: To see if the Town will vote to rescind the vote taken on Article 25 of the June 16, 2010 Annual Town Meeting or take any action thereon; (the text of this article follows: “To see if the Town will vote to transfer the sum of $62,025 from the Stabilization Fund to pay off the Fire Truck Note or take any action thereon.”)

ARTICLE 15: To see if the Town will vote to rescind the vote taken on Article 26 of the June 16, 2010 Annual Town Meeting or take any action thereon; (the text of this article follows: “To see if the Town will vote to transfer the sum of $78,562.50 from the Stabilization Fund to pay off the Meltzer Property note or take any action thereon.”)

ARTICLE 16: To see if the Town will vote to rescind the vote taken on Article 27 of the June 16, 2010 Annual Town Meeting or take any action thereon; (the text of this article follows: “To see if the Town will vote to transfer the sum of $62,940 from the Stabilization Fund to pay off the Fiske Pond note or take any action thereon.”)

ARTICLE 17: To transact any other legal business that may come before said meeting, or take any action thereon.

And you are directed to serve this Warrant by posting up attested copies thereof at the Wendell Country Store, Wendell Town Hall, Wendell Town Office Building, Wendell Library, and Wendell Depot Store 14 days at least prior to the time of holding said meeting.

Hereof fail not, and make due return of this Warrant with your doings thereon, to the Town Clerk, at the time and place of meeting, as aforesaid
