Â
In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn theÂ
inhabitants of said Town, qualified to vote in elections and in Town affairs, to meet in the Town Hall in saidÂ
Town on Tuesday, September 25, 2018 at 7 pm, then and there to act on the following articles:Â
Â
ARTICLE 1: To see if the Town will vote to appropriate, borrow or transfer from available funds, anÂ
amount of money to be expended under the direction of the Swift River School Building Committee forÂ
Schematic Design Study for the replacement of the windows and doors on the Swift River School located atÂ
201 Wendell Rd, New Salem, MA 01355, for which feasibility study the Town may be eligible for a grantÂ
from the Massachusetts School Building Authority. The MSBA’s grant program is a non-entitlement,Â
discretionary program based on need, as determined by the MSBA, and any costs the Town incurs inÂ
connection with the feasibility study in excess of any grant approved by and received from the MSBA shallÂ
be the sole responsibility of the Town. Â

ARTICLE 2: To see if the Town will vote to raise and appropriate or transfer from available funds the sumÂ
of $733.39 to fund the Stabilization Account established 6/16/2010 pursuant to MGL Chapter 40, Section 5BÂ
for the purpose of investing sick leave pay for FY2018.Â
Â
ARTICLE 3: To see if the Town will vote pursuant to the provisions of General Laws c.44, §53E½, as mostÂ
recently amended, to (1) establish the following revolving fund and fiscal year spending limits as set forthÂ
below, and further (2) to amend the General Bylaws by inserting a new bylaw establishing this revolvingÂ
fund, specifying the departmental receipts to be credited to each fund, the departmental purposes or programsÂ
for which each fund may be expended, and the entity authorized to expend each fund, such bylaw to provideÂ
as follows:Â

Departmental Revolving Fund:Â

Section 1.  There is hereby established in the Town of Wendell pursuant to the provisions of G.L.Â
c.44, §53E½, the following Revolving Fund, from which the specified department head, board,Â
committee, or officer may incur liabilities against and spend monies from without appropriation inÂ
accordance with the limitations set forth in this by-law.Â

Section 2.  No liability shall be incurred in excess of the available balance of the fund.Â
Â
Section 3.  The total amount spent during a fiscal year shall not exceed the amount authorized byÂ
Annual Town Meeting or any increase therein as may later be authorized  by the Board of SelectmenÂ
and Finance Committee in accordance with G.L. c.44, §53E½. Â

Section 4.  Interest earned on monies credited to a revolving fund established by this by-law shall beÂ
credited to the General Fund.Â

Section 6.  Procedures and Reports. Except as provided in General Laws Chapter 44, §53E½ and thisÂ
by-law, all applicable state and local laws and regulations that govern the receipt, custody,Â
expenditure and payment of town funds shall apply to the use of the revolving fund established andÂ
authorized by this by-law.Â

ARTICLE 4: To see if the Town will vote to transfer the sum of $1150.00 from the Stabilization Account toÂ
pay the Highland Press bill of prior year for printing the 2017 Annual Report, or take any action thereon.Â

ARTICLE 5: To see if the Town will vote to transfer the sum of $48.99 from the Stabilization Account toÂ
pay a Conservation Commission bill of prior year, or take any action thereon.Â
Â
ARTICLE 6: To see if the Town will vote to transfer the sum of $142.66 from the Stabilization Account toÂ
pay a Board of Health bill of prior year, or take any action thereon.Â
Â
ARTICLE 7: To see if the Town will vote, pursuant to  M.G.L. Chapter 59, Section 5, Clause 41A, to (1)Â
increase the maximum qualifying gross receipts amount (income allowance) for persons applying for aÂ
property tax deferral under said clause from the current limit of $20,000, as follows: $30,000 for a singleÂ
individual who is not the head of household, $35,000 for a head of household, and $40,000 for marriedÂ
couples filing a joint income tax return; and (2) decrease the interest rate on taxes deferred under said clauseÂ
from the statutory rate of 8% to such rate as is 1% below the Wall Street Journal’s published “Prime Rateâ€Â asÂ
of July 1 of the fiscal year for which the taxes have been deferred, or such other lower rate as Town MeetingÂ
may determine; or take any action thereon.Â

ARTICLE 8: To see if the Town will vote to appropriate $180,000 for the purchase of a front end loader forÂ
the Highway Department, and to meet this appropriation by transferring the sum of $30,000 from theÂ
Stabilization Fund and by authorizing the Treasurer, with approval of the Selectboard, to borrow up toÂ
$150,000 for the balance of the appropriation pursuant to Massachusetts General Laws Chapter 44, section 7Â
(1), or any other enabling authority, or take any action thereon.Â

ARTICLE 9: To transact any other legal business that may come before said meeting, or take any actionÂ
thereon.Â

And you are directed to serve this Warrant by posting up attested copies thereof at the Wendell Town OfficeÂ
Building, 14 days at least prior to the time of holding said meeting.Â
